1. Scope of Application

These General Terms and Conditions ("GTC") apply to all enquiries, offers and agreements between CHINA FORTIS GmbH ("we", "us") and customers ("you") regarding vehicle sourcing, import, transport coordination, documentation handling, homologation and registration support, and related services (the "Services").

If an individual written agreement (offer/quote, order confirmation) contains provisions that differ from these GTC, the individual agreement shall prevail.

2. Enquiries, Offers and Contract Conclusion

• Content on our website is provided for information purposes and does not constitute a legally binding offer.
• By submitting a request via the website, email or phone, you submit an enquiry for a quotation.
• A contract is concluded only when you accept our written offer/quote or when we confirm your order in writing (email is sufficient).

3. Service Territory

Services are provided for Switzerland and/or European destinations, depending on the agreed scope. The applicable requirements and procedures depend on the destination country and decisions of competent authorities/testing bodies. The destination and included steps are defined in the offer/order confirmation.

4. Our Services

Depending on the agreed package, our Services may include:

• Vehicle sourcing and coordination
• Import logistics and transport to the agreed destination
• Preparation and handling of required documentation
• Coordination of technical checks/inspections required by the destination country
• Coordination of homologation and registration steps so the vehicle can be legally registered and driven in the agreed destination

We manage the process from request to delivery and keep you informed throughout.

5. Customer Obligations

You agree to provide complete and accurate information and all documents required to perform the Services (e.g., identity details, vehicle data, purchase documents, authorisations).

Delays or additional costs resulting from missing/incorrect information or late cooperation may affect timelines and pricing.

6. Prices, Third-Party Fees and Payment

• Prices are stated in the currency shown in the offer/quote (e.g., CHF or EUR) unless stated otherwise.
• The service scope and price are defined in the written offer/order confirmation.
• Unless expressly stated otherwise, third-party and official costs (e.g., inspections/testing, authority fees, taxes, duties, customs charges, port/storage fees) are not included in our service fee and are either charged separately or paid directly to the respective body/provider.
• Payment terms (e.g., deposit, milestones, due dates) are specified in the offer/order confirmation.

7. Delivery, Timelines and Force Majeure

Timelines depend on vehicle availability, shipping routes, customs processes and appointment availability for inspections/registration steps in the destination country. Dates are indicative unless confirmed as binding in writing.

We are not responsible for delays caused by events outside our reasonable control (e.g., strikes, shipping disruptions, authority decisions, supply chain interruptions, extreme weather, force majeure).

8. Registration, Homologation and Authorities

We coordinate the agreed steps for homologation/registration based on the destination country requirements.

The final decision on approvals, inspections and registration remains with the competent authorities/testing bodies. We cannot guarantee specific authority outcomes.

9. Warranty / E-Protect

Statutory warranty rights apply where required by law and depending on the nature of the agreement.

If an additional coverage program (e.g., CHINA FORTIS E-Protect) is included in your package, the scope is governed by the respective warranty terms and exclusions provided to you.

10. Liability

• We act with professional care and are liable in accordance with applicable law.
• We are fully liable for intent, gross negligence and for personal injury (life, body, health).
• For slight negligence, our liability is limited to foreseeable damages typical for the contract, arising from the breach of essential contractual obligations, to the extent permitted by law.
• Liability for indirect or consequential damages (e.g., loss of profit) is excluded to the extent permitted by law.

11. Intellectual Property

All content on this website (texts, images, graphics, logos) is protected. Any use beyond normal viewing requires our prior written consent.

12. Governing Law and Jurisdiction

Unless mandatory consumer law in your place of residence provides otherwise, these GTC and all contractual relationships are governed by Swiss law.

The place of jurisdiction is the registered office of CHINA FORTIS GmbH, unless mandatory law provides otherwise.

The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded to the extent permitted.

13. Severability and Changes

If any provision of these GTC is invalid or unenforceable, the remaining provisions remain in effect.

We may update these GTC from time to time. The version published on this page applies.
